These Terms of Use (“Terms”) constitute a legally binding agreement between you (whether as an individual or a legal entity) and “Trustvestor Ltd.”, a company registered in the Republic of Bulgaria (“Trustvestor”, “We”, “Us”, or “Our”), concerning your access to and use of the Trustvestor.com website, as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Platform”).
By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Platform and must discontinue use immediately.
1. Definitions
- Platform: The Trustvestor.com website and all associated services, applications, and tools.
- Trustvestor/We: “Trustvestor Ltd.”, the operator of the Platform.
- User/You: Any person who accesses or uses the Platform, including Project Creators and Backers.
- Project Creator: A User who launches and manages a fundraising campaign on the Platform.
- Backer/Supporter: A User who supports a fundraising campaign on the Platform.
- Campaign: A fundraising project created by a Project Creator on the Platform.
- Reward: Any incentive offered by a Project Creator to a Backer in exchange for support.
- Funds: The amount of money raised for a Campaign.
- Privacy Policy: The policy describing the collection, use, and protection of personal data.
- Cookie Policy: The policy describing the use of cookies and similar technologies.
2. User Eligibility
The Platform is intended for Users who are at least 19 years of age. By using the Platform, you represent and warrant that you meet this age requirement.
3. Crowdfunding Model and Focus
Trustvestor.com is a crowdfunding platform focused on raising funds for projects without financial returns. This means that the support you provide does not yield equity, loan interest, or other financial benefits. Support may be reward-based, offering non-material or material goods, but not financial instruments.
Campaigns on the Platform can choose between two funding models:
- “All-or-Nothing”: Funds are paid to the Project Creator only if the Campaign reaches or exceeds its financial goal by the deadline. If the goal is not reached, collected funds are returned to the Backers.
- “Keep-It-All”: Funds are paid to the Project Creator even if the Campaign does not reach its financial goal.
The choice of model is at the sole discretion of the Project Creator and is clearly indicated on each Campaign’s page.
4. For Project Creators
4.1. Creator Requirements: To launch a project on Trustvestor.com, you must be at least 19 years old and a citizen of the European Union (EU), Switzerland, the United Kingdom (UK), Norway, Iceland, Andorra, Monaco, or San Marino. You must also have a valid bank account through which Funds will be processed and disbursed, and successfully complete the identification procedures in accordance with Section 6.5. (AML/KYC) of these Terms.
4.2. Project Validation/Approval: [This section is pending development. For example: Projects are subject to review and approval by Trustvestor to ensure compliance with our rules, legality, and ethical standards. We reserve the right to reject or remove a project at our discretion.]
4.3. Responsibility for Reward Delivery: The Project Creator bears full and sole responsibility for the delivery of all promised Rewards to the Backers. Trustvestor is not responsible for the fulfillment or quality of the Rewards.
4.4. Rules for Updates and Communication with Backers: [This section is pending development. Please add rules regarding the Project Creators’ obligation to provide regular updates to Backers on the progress of the project, as well as rules for communication and answering questions. For example: Project Creators undertake to provide regular and honest updates regarding the status and progress of their campaigns, especially if there are changes in reward delivery timelines. 5. For Backers (Supporters)
5.1. Support Process: [This section is pending development. Please add details on how Backers can support a project, how to select Rewards, and finalize their support. For example: To support a project, select your desired reward and follow the payment steps. Your support is processed through a secure payment system.]
5.2. Payment Methods: Trustvestor supports various payment methods, including, but not limited to, credit/debit cards and PayPal. The availability of specific methods may vary.
5.3. Refund Policy: Support for projects on Trustvestor is subject to our Refund Policy. Please read it carefully before supporting a project.
- Conditions for Refunds:
- Unsuccessful Campaign (for “All-or-Nothing” model only): If a Campaign using the “All-or-Nothing” model does not reach its financial goal by the deadline, all supported Funds are returned to the Backers.
- Non-delivery of Rewards: If a Project Creator fails to deliver promised Rewards in accordance with the Campaign’s timelines and terms, the Backer may be entitled to a refund. In such cases, the responsibility for refunding the Funds lies solely with the Project Creator. Trustvestor may assist with communication but does not guarantee a refund from the Creator.
- Proven Fraud: In rare cases of proven fraud, Trustvestor will take all necessary actions, including assisting law enforcement and attempting to recover Funds where possible.

5.4. Understanding Risks: You understand and accept that supporting a project on Trustvestor carries inherent risks. Supporting a project is not an investment and does not imply any financial return. There is no guarantee that the project will be successful, that Rewards will be delivered on time (or at all), or that they will meet your expectations. It is solely your responsibility to assess the risks before supporting a Campaign.
6. General Rules and Policies
6.1. Fees and Payments: Information regarding fees applied by Trustvestor, and the processes for payment and disbursement of funds, is available in our separate Fees and Payment Policy [EMPTY SECTION – add link to this policy when ready].
6.2. Prohibited Activities/Content Policy: The following activities and content are strictly prohibited on the Platform: * Projects or content that are illegal, dangerous, fraudulent, or promote illegal activity. * Projects or content that promote hatred, discrimination, violence, or harassment against groups or individuals based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected ground. * Projects or content related to weapons, ammunition, explosives, drugs, or illegal substances. * Projects or content that is false, misleading, or deceptive, especially regarding the project’s purpose, use of funds, or rewards offered. * Projects or content infringing copyrights, trademarks, or other intellectual property rights of third parties. * Personal fundraising campaigns for expenses not related to a clearly defined project (e.g., medical expenses, personal debts), unless explicitly permitted by the platform. * Financial schemes, pyramids, get-rich-quick schemes, or speculative “investment” projects. * Content that is defamatory, offensive, obscene, or pornographic. * Spam, unsolicited messages, or any actions that compromise the security or integrity of the Platform. * Any actions intended to manipulate the Platform’s support or rating system.
Violation of these rules may result in immediate suspension or removal of the Campaign and/or blocking of the user account, without prior notice and without right to a refund.
6.3. Intellectual Property: * Of the Platform: All content, design, logos, software, and functionalities of Trustvestor.com are the property of “Trustvestor Ltd.” and are protected by copyright and intellectual property laws. * Of Users: Project Creators retain all intellectual property rights related to their projects and content they upload to the Platform. By uploading content (text, images, videos, etc.) to the Platform, the Project Creator grants “Trustvestor Ltd.” a non-exclusive, royalty-free, worldwide, transferable license to use, reproduce, distribute, display, publicly perform, and adapt such content solely for the purpose of promoting the Campaign and operating the Platform.
6.4. Limitation of Platform Liability: * Trustvestor.com functions as a platform connecting project creators with supporters. We are not a party to any agreements between Project Creators and Backers. * Trustvestor is not responsible for the execution, quality, legality, or safety of projects or Rewards. * Trustvestor is not responsible for any damages or losses arising from non-fulfillment of Rewards, fraud by a Project Creator, or disputes between Users. * Trustvestor does not guarantee the successful execution of any project. * Trustvestor’s liability, if any, shall be limited to the fullest extent permitted by law.
6.5. User Identification (AML/KYC) Trustvestor is obligated to comply with anti-money laundering (AML) and counter-terrorist financing (CTF) regulations, as well as Know Your Customer (KYC) procedures. All Users (both Project Creators and Backers) are subject to identification and verification procedures, in accordance with the requirements of Regulation (EU) 2020/1503 on European crowdfunding service providers for business. These procedures may include, but are not limited to:
- Collection of personal identification data (name, address, date of birth, nationality).
- Identity verification through submission of official documents (e.g., ID card, passport).
- Bank account verification.
- Politically Exposed Persons (PEPs) and sanction list checks.
- Transaction monitoring. Trustvestor reserves the right to refuse the provision of services if the User does not provide the necessary information or fails to successfully complete the identification procedures. For the purposes of this regulation, no different thresholds or requirements are foreseen.
6.6. Dispute Resolution: [This section is pending development. Please add details about the process for resolving disputes between users or between a user and the platform. 6.8. Account Security and User Responsibilities
To ensure the security of your account and personal data on the Trustvestor.com platform, you agree to comply with the following instructions and bear responsibility for:
- Protecting Login Credentials:
- You are solely responsible for maintaining the confidentiality of your login credentials, including your username and password.
- Use a strong, unique password that you do not use for other online services.
- Do not share your login credentials with third parties and take all reasonable measures to prevent unauthorized access to your account.
- Immediately notify us via support@trustvestor.com if you suspect unauthorized access to your account, or loss or theft of login credentials.
- Using Two-Factor Authentication (2FA):
- If the platform offers a two-factor authentication option, we strongly recommend that you activate and use it for an additional layer of security.
- Account Monitoring:
- Regularly review your transaction history and account activity for any unauthorized or suspicious actions.
- Report any discrepancies or suspicious activity immediately.
- Vigilance Against Scams and Phishing:
- Be extremely cautious of emails, messages, or websites that appear to be from Trustvestor but request personal information or login credentials. We will never ask for your password via email or phone.
- Always verify the website’s URL to ensure you are on the official Trustvestor.com.
- Avoid clicking on suspicious links and downloading attachments from unknown sources.
- Device and Network Security:
- Ensure that the device (computer, phone) you use to access the Platform is protected with up-to-date antivirus software and a firewall.
- Always use secure and reliable internet connections. Avoid logging into your account via public, unsecured Wi-Fi networks.
- Always log out of your account when you are finished, especially if you are using a shared or public computer.
- Accuracy of Information:
- You are responsible for providing and maintaining accurate and up-to-date information in your account.
Any violation of these security instructions may lead to the compromise of your account and potential losses, for which Trustvestor shall not be held liable.
7. Changes to the Terms of Use
Trustvestor reserves the right to modify these Terms of Use at any time. All changes will be effective immediately upon their publication on the Platform. We will notify only registered creators and backers of any material changes by sending a notice to the email address associated with their account. Your continued use of the Platform after such changes will constitute your acceptance of the updated Terms.
